Disclosure and Barring Service for Trustees
The Out of School Childcare sector is made up of many different legal structures such as private providers, voluntary managed committees, school or local authority run.
In some cases those who oversee the business also work in the business on a day to day basis with the children, however for many voluntary managed committees this is not the case.
Any trustee/committee member can be asked to apply for an Enhanced DBS check and if you are registered with the Charity Commission you must have a DBS check.
To be eligible for an Enhanced DBS check you must carry out work that falls into the legal definition of regulated activity with children or in the case of trustees manage or supervise someone who does. Out of School Childcare Clubs meet the definition of regulated activity and so trustees should apply for an Enhanced DBS check.
To also be checked against the Children’s Barred List any trustee/committee member must be the responsible person/individual who undertakes the line management of the person in charge of running the provision.
When completing a DBS application request for a trustee / committee member in the first instance it should be an Enhanced DBS check as the Out of School Childcare sector is a ‘regulated activity provider’. The application may request a job role to be able to access the enhanced level; ‘Trustee / Childcare Manager’ may be used and this would also allow for a check against the Children’s Barred List.
